Terms of Service

1. Acknowledgement
These Terms of Service ("Terms") are a legal agreement between you and IGOLFBETTER, LLC ("iGolfBetter", "we", "us", or "our") governing your use of the iGolfBetter mobile application and the igolfbetter.app website (together, the "Service"). These Terms are concluded between you and IGOLFBETTER, LLC only — notwith Apple Inc. ("Apple") or Google LLC ("Google"). We, not Apple or Google, are solely responsible for the Service and its content. For the iOS app, these Terms replace Apple's standard Licensed Application End User License Agreement.
By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility and Your Account
You must be at least 13 years old (or the higher minimum age required in your jurisdiction) to use the Service. You agree to provide accurate account information and to keep your login credentials secure. You are responsible for all activity under your account. Accounts are personal and may not be shared or transferred.
3. License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes on devices that you own or control, and as permitted by the usage rules of the app store from which you obtained it (for iOS, the App Store Usage Rules set out in the Apple Media Services Terms and Conditions). You may not copy, modify, distribute, sell, rent, reverse engineer, or create derivative works of the app or any of its content except as permitted by law.
4. Subscriptions and Billing
- Access to most content requires a paid subscription. Prices, plans, and subscription lengths are shown in the app before purchase.
- Payment is charged to your Apple ID or Google account at confirmation of purchase.
- Subscriptions renew automatically unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period, at the then-current price.
- You can manage or cancel your subscription at any time in your App Store or Google Play account settings. Deleting the app or your iGolfBetter account does not cancel a subscription.
- Purchases and refunds are handled by Apple or Google under their terms; we cannot issue refunds for purchases made through the app stores.
- Promotional offer codes, where available, are redeemed through the App Store or Google Play redemption flows and are subject to the stores' terms.
- If a subscription price changes, you will be notified in accordance with the applicable app store's rules and, where required, asked to consent before the new price applies.
5. Content and Intellectual Property
All videos, training programs, text, graphics, logos, and other materials in the Service are owned by IGOLFBETTER, LLC or its licensors and are protected by copyright and other intellectual property laws. Except for the limited license in Section 3, no rights in the Service or its content are transferred to you. You may not download (other than app-provided caching), record, scrape, or redistribute any video content, or circumvent any content protection or access controls.
6. Acceptable Use
- Do not share your account or resell access to the Service.
- Do not attempt to gain unauthorized access to the Service or its systems.
- Do not use automated means (bots, scrapers) to access the Service or extract content.
- Do not use the Service in violation of any applicable law.
We may suspend or terminate accounts that violate these Terms.
7. Health and Physical Activity Disclaimer
The Service provides golf instruction, drills, and physical training content. Golf and the exercises shown involve physical activity that carries an inherent risk of injury. Consult a physician before beginning any training program, and stop immediately if you experience pain or discomfort. You use the instruction and drills at your own risk; the Service does not provide medical advice.
8. Maintenance and Support
We are solely responsible for providing any maintenance and support for the app. You can reach us at info@igolfbetter.app. Apple has no obligation to furnish any maintenance or support services for the app.
9. Warranty
The Service is provided "as is" and "as available". To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. In the event of any failure of the iOS app to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app (if any) to you; to the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the app, and any other warranty claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are our sole responsibility.
10. Product Claims
We, not Apple, are responsible for addressing any claims by you or a third party relating to the app or your possession and/or use of the app, including but not limited to: (i) product liability claims; (ii) any claim that the app fails to conform to an applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
11. Intellectual Property Claims
In the event of any third-party claim that the app or your possession and use of the app infringes that third party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement, and discharge of such claim.
12. Legal Compliance
You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
13. Third-Party Terms
You must comply with any applicable third-party terms of agreement when using the Service (for example, your wireless carrier's data agreement).
14. Apple as Third-Party Beneficiary
Apple and Apple's subsidiaries are third-party beneficiaries of these Terms as they apply to the iOS app, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
15. Termination and Account Deletion
These Terms are effective until terminated. We may suspend or terminate your access to the Service if you breach these Terms. You may stop using the Service at any time and may permanently delete your account in the app under Account → Settings → Delete account. Termination does not entitle you to a refund for any unused portion of a subscription, which remains governed by the applicable app store's terms.
16. Limitation of Liability
To the maximum extent permitted by applicable law, IGOLFBETTER, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of the Service. Our total liability for any claim arising out of these Terms or the Service will not exceed the amount you paid us for the Service in the twelve months preceding the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
17. Governing Law
These Terms are governed by the laws of the state of Florida, United States of America, without regard to its conflict-of-law rules. Nothing in this section deprives you of mandatory consumer protections under the law of the country in which you reside.
18. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and may require you to review and re-accept the updated Terms in the app before continuing to use the Service.
